Appendix L. Will of Richard Thorp, 1757-1844

Transcription of the Codicil to Richard Thorp’s Will (RT: bp15.7.1757, d.11.4.1844)

Richard Thorp I Richard Thorp of Knotting in the county of Bedford, farmer, being of sound and disposing mind, memory and understanding but mindful of mortality do this 25th day of April 1842 make and publish this my last will in manner and form following that is to say I give and bequeath to my son William Thorp of Hadley in the County of Middlesex, brewer, and Maria Adcock the wife of Mr. James Adcock of Wellingborough, draper, all rights and interests that may be remaining to me at my decease in the leasehold estate situated at Headley aforesaid now occupied by the aforesaid Will Thorp as Common Brewer. I also give and bequeath to the aforementioned Will Thorp and Maria Adcock the sum of 100 pounds each, also to my daughter Margaret Hine the wife of Mr George Hine of Knotting the sum of 300 pounds, also to my 4 grandchildren one son and three daughters being the children of Benjamin and Sarah Tuck my late daughter deceased the sum of 15 pounds each, the above legacies to be paid immediately on the expiration of one year after my decease except them that may be under the edge of 21 years at that time and their share to be paid them when they respectively attain that age but should any of them die before they attain the age of 21 years then their share or shares must be divided equally amongst them that are living and as to all the rest and residue of my effects whatsoever and wheresoever nature kind or quality the same may be and not heretoforth given or disposed of after payment of my debts legacies and funeral expenses I do hereby give and bequeath to my son Thomas Thorp of Leighton in the County of Huntington, farmer, his executors administrators or assignees to and for their own use absolutely and I do make ordain institute and appoint my son Thomas Thorp sole executor of this my last will and testament In witness whereof I have set my hand and seal the day and year before mentioned _ Richard Thorp___ signed sealed published and declared in the presence of each other to subscribe our names at his request as witnesses thereto  William Carter_ Mary Ward.

Codicil  Whereas  Richard Thorp of Knotting in the County of Bedford have by my last will and testament bearing the date the 25th day of April 1842 given and bequeathed etc I do hereby alter that part or parts of my will whereby I bequeath my ** property to Maria Adcock (late Maria Thorp and then wife of my late son Robert Thorp deceased) and I hereby bequeath the same to the children of the late Robert Thorp and Maria Thorp (now Maria Adcock) to share and share alike and I do hereby ratify and confirm my said will in everything except where the same is hereby **and altered as aforesaid. In witness whereof I have set my hand this 10th day of April 1843_ Richard Thorp _ signed sealed and published and declared by the said testator Richard Thorp as and for a codicil to be annexed to his last will and testament and to be taken as part thereof in the presence of us William Carter_ Mary Ward.

Appeared Personally Mary Ward of Knotting in the County of Bedford, spinster and made oath that she is one of the subscribed witnesses to the last will and testament and also to the Codicil thereto of Richard Thorp, late of of Knotting in the County of Bedford, farmer, deceased the same being now respectively hereunto annexed to the said will bearing the date the twenty-fifth day of April one thousand eight hundred and forty-two and the Codicil the tenth day of April one thousand eight hundred and forty-three and that the said deceased signed the said will and codicil at the foot or end thereof respectively in the presence of this deponent and William Carter the other attesting witness to the said will and codicil who were both then present at the same time and thereupon attested and subscribed the said will and codicil respectively in the presence of the said Richard Thorp deceased on the respective days of the dates thereof aforesaid – Mary Ward. On the eighteenth of June 1844 the said Mary Ward was duly sworn to the truth of this Affidavit by virtue of the annexed commission before me Henry Green Officiating Minister of the Parish of Knotting in the County of Bedford.

Proved at London with a codicil the 26th June 1844 before the Judge by the oath of Thomas Thorp the son, the sole executor to whom Administration was granted having been first sworn by commission duly to administer.
